Платить налог с продажи квартиры?

ВОПРОС: Здравствуйте! Надо ли мне платить налог с продажи квартиры? Квартира была приобретена в браке 10 лет назад, но оформлена только в собственность только супруга. После развода по решению суда, мне досталась половина квартиры. Эта половина была официально переоформлена на меня за месяц до продажи всей квартиры третьим лицам. Должна ли я подавать декларацию и платить налог с моей половины, ведь фактически это было моей собственностью 10 лет, а не 1 месяц? Стоимость квартиры более 3 млн. Если нет, то на какой документ я могу сослаться при возникновении споров с налоговой?

ОТВЕТ:Согласно пункту 17.1 статьи 217 НК РФ не подлежат налогообложению НДФЛ (освобождаются от налогообложения) доходы, получаемые физическими лицами, являющимися налоговыми резидентами РФ, за соответствующий налоговый период от продажи, в частности, квартиры и долей в ней, находившихся в собственности налогоплательщика три года и более. С учетом определения Конституционного Суда РФ от 02.11.2006 N 444-О при установлении периода, в течение которого отчужденное налогоплательщиком имущество находилось в его собственности, должны приниматься во внимание положения пункта 1 статьи 256 ГК РФ, устанавливающие, что имущество, нажитое супругами во время брака, является их совместной собственностью. Пунктом 4 статьи 256 ГК РФ предусмотрено, что определение долей супругов в общем имуществе производится при его разделе в порядке, установленном семейным законодательством. На основании положений статей 38 и 39 Семейного кодекса РФ общее имущество супругов может быть разделено между супругами по их соглашению. При этом доли супругов признаются равными, если иное не предусмотрено договором между супругами. Таким образом, срок владения одним из супругов конкретным объектом имущества, полное право распоряжения которым такой супруг получил в результате произведенного раздела общего имущества, нажитого во время брака, исчисляется с даты приобретения этого объекта на имя любого из супругов ранее. Следовательно, при продаже в 2014 или 2015 году доли квартиры, полученной налогоплательщиком при расторжении брака на основании решения суда об определении доли в квартире, приобретенной более 10 лет назад, срок нахождения данного имущества в собственности налогоплательщика исчисляется с этого периода. Значит, налогооблагаемый доход в связи с продажей указанной доли квартиры отсутствует.

Могу ли не платить налог с продажи квартиры

ВОПРОС: Добрый день. У меня есть справка члена ЖСК о праве собственности квартиры. Где указано, что я оплатила все паевые взносы в 1992. Регистрация права собственности оформлена в 2013. Могу ли я использовать эту справку для того, чтобы не платить налог с продажи квартиры?

ВОПРОС: Добрый день! В феврале открыла ИП, но по личным обстоятельствам бизнес не заработал. Заявление на переход на упрощенную систему налогообложения не подавала. Подскажите, пожалуйста: какую отчетность в налоговую инспекцию я должна предоставить и за какой период времени? Спасибо.

ОТВЕТ:Если вы не имели дохода вам необходимо будет сдать нулевую декларацию по форме 3-НДФЛ за 2014 год до 30 апреля 2015. Но так как вы не перешли на УСНО вам необходимо было ежеквартально до 20 числа месяца, следующего за отчетным сдавать декларации по НДС (нулевые). Эти декларации начиная с 2014 года принимаются только по электронным каналам связи (мы оказываем данные услуги если вас это заинтересует) Перейти на УСН вы можете со следующего года, подав заявление до 31 декабря этого года, подав соответствующее уведомление в свой налоговый орган.

Ввозной НДС при импорте товаров

ВОПРОС: Добрый день! Помогите прояснить ситуацию. Иностранная организация (Республика Беларусь) состоит на учете в налоговом органе РФ в качетсве налогоплательщика ЕНВД по месту нахождения своего филиала в РФ. Облагается ли ввоз товара белорусской организацией с территории РБ ее филиалу косвенным НДС (ввозной НДС при импорте товаров). Заранее спасибо.

ОТВЕТ:Передача товаров головной организацией, находящейся на территории одного государства - члена Таможенного союза, своему структурному подразделению, находящемуся на территории другого государства - члена Таможенного союза, не оформляется договором, согласно которому происходит приобретение товаров структурным подразделением. Соответственно, при передаче товаров головной организацией, находящейся на территории Республики Беларусь, своему структурному подразделению, находящемуся на территории Российской Федерации, филиал НДС не уплачивает и заявление о ввозе товаров в налоговый орган не представляет.

Отчетность общественной организации

ВОПРОС: Добрый день! Зарегистрировали общественную организацию, хотелось бы уточнить какие отчеты надо сдавать и когда.

ОТВЕТ:Общественные организации, как другие прочие организации, обязаны представлять отчетность: в налоговый орган - ежеквартально, как минимум - НДС до 20 числа,налог на прибыль до 28 числа,налог на имущество до 28 числа, следующего за отчетным периодом, бухгалтерская отчетность как годовая отчетность до 30 марта, сведения о среднесписочной численности организации до 20 января следующего за отчетным годом. в пенсионный фонд - ежеквартальная отчетность до 15 числа второго месяца, следующего за отчетным периодом. в фонд социального страхования - ежеквартальная отчетность до 15 числа первого месяца, следующего за отчетным периодом. органы статистики в зависимости от вида деятельности организации. минюст - годовые сведения о деятельности организации.

Как учесть материалы

ВОПРОС: дравствуйте! ООО занимается пошивом детской одежды, система н/о - УСН доходы минус расходы, по своим рисункам заказали сторонней организации изготовление лекал. Как учесть в БУ эти лекала?

ОТВЕТ:Изготовленные сторонней организацией лекала отражаются в учете на счетах "материалы", также как и прочие составляющие материалы, необходимые для производства готовой продукции.
